Terms of Use — Funity Games

These terms of use apply to the mobile games of Funity UG (haftungsbeschränkt), Poloweg 4, 85131 Pollenfeld (“Funity”, “we”), especially Chika Sudoku and other Funity Games titles. By installing or using the app you accept these terms.

2. Description of services
Funity Games are digital games (including puzzle and action) with optional gameplay features. The feature set may change through updates.
The free version may include advertising. Individual content or ad-free mode may be offered for a fee as an in-app purchase.
3. Requirements for use
- Suitable device and compatible Android version
- For purchases and ads where applicable: internet access and a Google Play account
- Recommended minimum age / audience: from about age 12 (see store listing)
Minors may use the app only with parental consent where required by law.
4. Account and storage
No separate Funity user account is required. Progress and settings are stored primarily locally on the device. If you change devices, reinstall, or lose data, progress may be lost unless a store-side restore (e.g. for purchases) applies.
5. In-app purchases
Purchases are processed through the respective app store (Google Play). The store provider’s terms also apply. Prices and availability may vary by region.
Withdrawal and refund rights follow applicable law and Google Play policies. For purchase issues, contact store support first; we will help where we can at kontakt@funity.de.
6. Advertising
The free version may show ads (including video and full-screen ads). Details on data processing are in the Privacy Policy.
7. Acceptable use
In particular, the following is prohibited:
- Abuse, cheating, or manipulation of purchases/ads
- Reverse engineering beyond what the law allows
- Using the app in a way that harms us, other users, or third parties
8. Intellectual property
The app, trademarks, graphics, sounds, and texts are protected by copyright and/or trademark law. You receive a simple, non-transferable right to use the app privately and non-commercially under these terms.
9. Availability and changes
We aim for stable operation but do not guarantee uninterrupted availability. Features, content, and prices may change. We may stop providing the app for important reasons (e.g. store rules, security, commercial viability).
10. Liability
We are liable without limitation for intent and gross negligence, under the Product Liability Act, and for injury to life, body, or health.
For slight negligence we are liable only for breach of essential contractual duties (cardinal duties), limited to typical foreseeable damage. Liability is otherwise excluded.
We are not liable for data loss to the extent the damage could have been avoided by reasonable backup (e.g. device backup).

12. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected.
